GENERAL TERMS AND CONDITIONS MEC SHOP
Introduction
Below you will find our General Terms and Conditions. These are always applicable when you use or place an order through our website and contain important information for you as a buyer. Therefore, please read the General Terms and Conditions carefully. We also recommend that you save or print these conditions so that you can read them again at a later date.
Definitions
1. MEC Events: established in PUTTEN and registered with the Chamber of Commerce in Almere under KVK number 60153121 trading under the name MEC Shop.
2. Website: the website of MEC Events, which can be consulted via www.mecshop.nl and all corresponding subdomains.
3. Client: the natural person not acting in the exercise of a profession or business who enters into an agreement with MEC Events and/or registers on the website.
4. Agreement: any arrangement or agreement between MEC Events and the client, of which the General Terms and Conditions form an integral part.
5. General Terms and Conditions: the present General Terms and Conditions.
Applicability of the General Terms
1. The General Terms apply to all offers, agreements and deliveries of MEC Events, unless otherwise expressly agreed in writing.
2. Should the client, in his order, confirmation or notification of acceptance, include terms or conditions which deviate from, or do not appear in, the General Terms and Conditions, these are only binding for MEC Events if and insofar as these have been expressly accepted in writing by MEC Events.
3. Should specific product or service conditions apply in addition to these General Terms and Conditions, these conditions shall also apply, but the client may, in the case of conflicting conditions, invoke the applicable provision which is the most favourable to him.
Prices and information
1. All prices mentioned on the website and in other materials originating from MEC Events are inclusive of VAT and other government levies.
2. If shipping costs are charged, this will be clearly stated in good time before the contract is concluded. In addition, these costs will be displayed separately in the ordering process.
3. The content of the website has been compiled with the greatest care. However, MEC Events cannot guarantee that all the information on the website is correct and complete at all times. All prices and other information on the website and in other materials from MEC Events are therefore subject to obvious programming and typing errors.
4. MEC Events cannot be held responsible for (colour) deviations due to screen quality.
Conclusion of contract
1. The contract is concluded at the moment of acceptance by the client of the offer of MEC Events and the fulfilment of the conditions set by MEC Events.
2. If the client has accepted the offer electronically, MEC Events confirms without delay the electronic receipt of the acceptance of the offer. As long as the receipt of this acceptance has not been confirmed, the client has the possibility to dissolve the contract.
3. If it appears that incorrect data have been supplied by the client when accepting or otherwise entering into the contract, MEC Events has the right to fulfil its obligations only after having received the correct data.
4. MEC Events can, within the limits of the law, inform itself whether the customer can fulfil his payment obligations, but also of all facts and factors which are important for the sound conclusion of the contract. If MEC Events has good reason not to enter into the agreement on the basis of this examination, it may refuse an order or request while giving reasons, or attach special conditions to the execution, such as prepayment.
5. MEC Events has the right to refuse orders from clients who act in the exercise of their profession or business.
Registration
1. In order to make optimal use of the website, the customer can register via the registration form/account login option on the website.
2. During the registration procedure, the customer chooses a user name and password with which he can log on to the website after registration. Customer is responsible for choosing a sufficiently reliable password.
3. The client must keep his login details, user name and password strictly confidential. MEC Events is not liable for any abuse of the login data and may always assume that a client who logs on to the website is actually that client. Everything that happens through the account of the client is the responsibility and the risk of the client.
4. If the customer knows or suspects that his login details have come into the hands of unauthorised persons, he must change his password as soon as possible and/or inform MEC Events, so that MEC Events can take appropriate measures.
Execution of the agreement
1. Once the order is received by MEC Events, MEC Events sends the products as soon as possible in accordance with the provisions of paragraph 3 of this Article.
2. MEC Events is entitled to involve third parties in the execution of the obligations which follow from the agreement.
3. The delivery time is in principle 7 working days. The delivery can take place in different ways and is at the discretion of MEC Events.
4. If MEC Events cannot deliver the products within the agreed time period, it informs the client thereof. In that case the customer can agree to a new delivery date or he has the possibility to dissolve the contract without any costs.
5. MEC Events recommends the client to inspect the delivered products and to report any defects within a reasonable time, preferably in writing. See further the article on guarantee and conformity.
6. As soon as the products have been delivered to the specified delivery address, the risk for these products is transferred to the client. If expressly agreed otherwise, the risk will pass to the customer at an earlier stage. If the customer decides to collect the products, the risk is transferred when the products are handed over.
7. MEC Events is entitled to deliver a similar product of similar quality as the ordered product, if the ordered product is no longer available. The client is then entitled to dissolve the contract and return the product free of charge.
Right of withdrawal
1. The client has the right to dissolve the distance contract with MEC Events within 14 calendar days of receipt of the product, without giving reasons. The period begins the day after the customer, or a third party designated by him in advance, which is not the carrier, has received the product, or: if the customer in the same order has ordered multiple products: the day when the customer, or a third party designated by him, the last product has received. if the delivery of a product consists of several shipments or parts: the day when the customer, or a third party designated by him, the last shipment or part has received; in agreements for regular delivery of products during a certain period: the day when the customer, or a third party designated by him, the first product has received.
2. Only the direct costs for the return shipment are at the expense of the customer. Customer must therefore bear the return costs himself. If these costs are higher than the regular postal rate, MEC Events will give an estimate of these costs. Any costs paid by the customer for shipping and payment of the product to the customer will be refunded upon return of the entire order.
3. Within the revocation period referred to in paragraph 1 the customer shall handle the product and its packaging with care. The customer shall only open the packaging and use the product to the extent necessary to verify the nature, characteristics and operation of the product. The basic assumption here is that this inspection may not go any further than what the Customer would be able to do in a physical shop.
4. Customer is only liable for decrease in value of the product that is the result of a way of handling the product that goes beyond what is allowed in the previous paragraph.
5. The customer can dissolve the agreement in accordance with the provisions of paragraph 1 of this Article by sending the model withdrawal form (digitally) to MEC Events or by other unambiguous means to indicate to MEC Events that he wishes to cancel the purchase. MEC Events confirms the receipt of the digital notification. After the dissolution, the customer has 14 days to return the product. It is also possible to return the product directly within the cooling-off period set out in paragraph 1 of this Article, provided that the model form for withdrawal or other unequivocal declaration for withdrawal is enclosed.

- Amounts already paid by the client will be refunded as soon as possible, but not later than 14 days after the termination of the contract, in the same way the client paid for the order. If the customer has chosen a more costly method of delivery than the cheapest standard delivery, MEC Events does not have to refund the additional costs of the more costly method. Unless MEC Events offers to collect the product itself, MEC Events may delay payment until MEC Events has received the product or until the customer proves that he has returned the product, whichever is the earliest.
7. On the website information on the applicability of the right of withdrawal and any desired procedure shall be stated clearly and in good time before the conclusion of the contract.
8 .The right of withdrawal does not apply to:
-Products which have been created by the entrepreneur in accordance with the specifications of the customer;
-loose newspapers and magazines;
-Audio and video recordings and computer software of which the customer has broken the seal;
-Products which are not suitable to be returned for reasons of health protection or hygiene and of which the seal has been broken after delivery;
-The delivery of digital content other than on a material carrier if the execution has started with the explicit prior consent of the customer and he has declared that he thereby loses his right of withdrawal.
Payment
1. The client must pay MEC Events according to the payment methods indicated in the order procedure and on the website. MEC Events is free in its choice of payment methods and these may also change from time to time. In case of payment after delivery the client has a payment term of 14 days starting from the day after delivery.
Guarantee and conformity
1. MEC Events guarantees that the products are in accordance with the contract, the specifications mentioned in the offer, the reasonable requirements of reliability and/or usability and the existing legal provisions and/or government regulations at the time of the conclusion of the contract. If specifically agreed, MEC Events also guarantees that the product is suitable for other than normal use.
2. A guarantee issued by MEC Events, manufacturer or importer does not affect the legal rights and claims which the customer already has and can invoke on the basis of the agreement.
3. If the delivered product does not fulfil the agreement, the customer has to notify MEC Events within a reasonable time after he has discovered the defect.
4. If MEC Events considers the complaint justified, the relevant products will be repaired, replaced or compensated after consultation with the client. The maximum compensation is equal to the price paid by the client for the product. This article does not prevent a claim for possible compensation.
Complaints procedure
1. If the client has a complaint about a product (in accordance with article concerning guarantee and conformity) and/or other aspects of the services of MEC Events, he may lodge a complaint with MEC Events by telephone, e-mail, whatsapp or post. See the contact details at the bottom of the General Terms and Conditions.
2. MEC Events replies to the complaint as soon as possible, but in any case within 7 days after receipt of the complaint. If it is not yet possible to give a substantive or definitive reaction, MEC Events will confirm the receipt of the complaint within 7 days and give an indication of the period within which it expects to give a substantive or definitive reaction to the complaint of the customer.
3. The customer can also submit a complaint via the European dispute resolution platform, which can be reached at https://webgate.ec.europa.eu/odr/.
Personal data
1. MEC Events processes the personal data of the client in accordance with the privacy statement published on the website.
Final provisions
1. The agreement is subject to Dutch law.
2. Insofar as rules of mandatory law do not dictate otherwise, all disputes which may arise from the agreement will be brought before the competent Dutch court in the district where MEC Events has its registered office.
3. Should a provision in these general terms and conditions prove to be invalid, this shall not affect the validity of the general terms and conditions in their entirety. The parties will in that case replace the invalid provision with a new provision or provisions which will fulfil the intention of the original provision as much as is legally possible.
4. In these General Terms and Conditions, the term "written" also includes communication by e-mail and whatsapp, provided that the identity of the sender and the integrity of the e-mail is sufficiently clear.
