GENERAL TERMS AND CONDITIONS MEC SHOP

Introduction
Below you will find our Terms and Conditions. These always apply when you use or place an order through our website and contain important information for you as a buyer. Please read the Terms and Conditions carefully. We also recommend that you save or print these terms and conditions so that you can read them again at a later time.

Definitions
1. MEC Shop B.V.: established in PUTTEN and registered with the Chamber of Commerce under KVK Number 90704673.
2. Website: the website of MEC Shop B.V., to be consulted via www.mecshop.eu and all associated subdomains.
3. Customer: the natural person not acting in the exercise of a profession or business who enters into an agreement with MEC Shop B.V. and/or has registered on the website.
4. Agreement: any arrangement or agreement between MEC Shop B.V. and customer, of which agreement the General Terms and Conditions form an integral part.
5. General Terms and Conditions: the present General Terms and Conditions.

Applicability of General Terms and Conditions
1. All offers, agreements and deliveries of MEC Shop B.V. are subject to the General Terms and Conditions, unless expressly agreed otherwise in writing.
2. If customer, in his order, confirmation or communication containing acceptance, includes provisions or conditions that deviate from, or do not appear in, the General Terms and Conditions, these are only binding for MEC Shop B.V. if and insofar as they have been expressly accepted in writing by MEC Shop B.V.
3. In the event that specific product or service conditions apply in addition to these General Terms and Conditions, those conditions also apply, but in the event of conflicting conditions, the customer may always rely on the applicable provision that is most favorable to him.

Prices and Information
1. All prices mentioned on the website and in other materials originating from MEC Shop B.V. are inclusive of VAT and other levies imposed by the government.
2. If shipping costs are charged, this will be clearly stated in good time before the agreement is concluded. In addition, these costs will be shown separately in the ordering process.
3. The content of the website has been compiled with the greatest care. MEC Shop However, B.V. cannot guarantee that all information on the website is correct and complete at all times. All prices and other information on the website and in other materials originating from MEC Shop B.V. are therefore subject to apparent programming and typing errors.
4. MEC Shop B.V. cannot be held responsible for (color) deviations due to screen quality.

Realization of agreement
1. The agreement is established at the moment of acceptance by customer of the offer of MEC Shop B.V. and the satisfaction of the conditions thereby established by MEC Shop B.V.
2. If customer has accepted the offer electronically, MEC Shop B.V. will immediately confirm electronically the receipt of the acceptance of the offer. As long as the receipt of this acceptance has not been confirmed, customer has the option to dissolve the agreement.
3. If it appears that incorrect data were provided by the customer when accepting or otherwise entering into the agreement, MEC Shop B.V. is entitled to fulfill its obligation only after the correct data have been received.
4. MEC Shop B.V. can inform itself within legal frameworks whether customer can meet its payment obligations, but also of all facts and factors that are important for a responsible conclusion of the agreement. If MEC Shop B.V. has good grounds on the basis of this investigation not to enter into the agreement, he is entitled to refuse an order or application with motivation or to attach special conditions to the implementation, such as advance payment.
5. MEC Shop B.V. has the right to refuse orders from customers acting in the exercise of their profession or business.

Registration
1. To make best use of the website, customer can register via the registration form/ account sign-up option on the website.
2. During the registration process, Customer chooses a username and password with which to log on to the Website after registration. Customer is responsible for choosing a sufficiently reliable password.
3. Customer must keep his login data, his username and password strictly confidential. MEC Shop B.V. is not liable for abuse of the login data and may always assume that a customer who logs on to the website is actually that customer. Everything that happens via the customer's account is the responsibility and risk of the customer.
4. If customer knows or suspects that his login details have come into the hands of unauthorized persons, he should change his password as soon as possible and/or notify MEC Shop B.V. of this, so that MEC Shop B.V. can take appropriate measures.

Execution of agreement
1. As soon as the order is received by MEC Shop B.V., MEC Shop B.V. will send the products as soon as possible, taking into account the provisions in paragraph 3 of this article.
2. MEC Shop B.V. is entitled to engage third parties in the performance of its obligations under the agreement.
3. The delivery period is in principle 7 working days. The method of delivery can take place in various ways and is at the discretion of MEC Shop B.V.
4. If MEC Shop B.V. is unable to deliver the products within the agreed period, it will notify the customer. In that case, customer can agree to a new delivery date or he is given the opportunity to dissolve the agreement free of charge.
5. MEC Shop B.V. advises the customer to inspect the delivered products and to report any defects found within a reasonable time, preferably in writing. See further the article on guarantee and conformity.
6. As soon as the products to be delivered have been delivered to the specified delivery address, the risk, where these products are concerned, passes to customer. If expressly agreed otherwise, the risk shall pass to customer at an earlier stage. If customer decides to collect the products, the risk shall pass upon transfer of the products.
7. MEC Shop B.V. is entitled to deliver a similar product of similar quality as the product ordered, if the product ordered is no longer available. Customer is then entitled to dissolve the agreement free of charge and return the product free of charge.

Right of withdrawal
1. Customer has the right to terminate the distance contract concluded with MEC Shop B.V. within 14 calendar days of receiving the product, without giving reasons, free of charge. The period starts on the day after the customer, or a third party designated by him beforehand, who is not the carrier, has received the product, or: if customer has ordered several products in one order: the day on which customer, or a third party designated by him, has received the last product. if the delivery of a product consists of several consignments or parts: the day on which customer, or a third party designated by him, has received the last consignment or part; in the case of contracts for regular delivery of products during a given period: the day on which customer, or a third party designated by him, has received the first product.
2. Only the direct costs for the return shipment shall be borne by customer. Customer must therefore bear the return costs himself. If these costs are higher than the regular postal rate, MEC Shop B.V. will provide an estimate of these costs. Any costs paid by customer for shipping and payment of the product to customer will be refunded to customer upon return of the entire order.
3. Within the revocation period referred to in paragraph 1, Customer shall handle the product and packaging with care. customer shall only open the packaging and use the product to the extent necessary to inspect the nature, characteristics and operation of products. The premise here is that this inspection may not go any further than that Customer could in a physical store.
4. Customer is only liable for depreciation of the product resulting from a way of handling the product that goes beyond that permitted in the previous paragraph.
5. Customer can dissolve the agreement in accordance with the period stipulated in paragraph 1 of this article by sending the model withdrawal form (digitally) to MEC Shop B.V., or otherwise unambiguously informing MEC Shop B.V. that he renounces the purchase. MEC Shop B.V. confirms in case of a digital notification the receipt of that notification. After dissolution, the customer still has 14 days to return the product. It is also possible to return the product directly within the cooling-off period stated in paragraph 1 of this article, provided that the model withdrawal form or other unambiguous declaration for withdrawal is enclosed.

  1. Amounts already paid by customer (in advance) will be refunded to customer as soon as possible, but at the latest within 14 days after dissolution of the agreement in the same way that customer paid for the order. If customer has opted for a more expensive method of delivery than the cheapest standard delivery, MEC Shop B.V. does not have to refund the additional costs for the more expensive method Unless MEC Shop B.V. offers to pick up the product itself, MEC Shop B.V. may wait with repayment until MEC Shop B.V. has received the product or until customer proves that he has returned the product, whichever is earlier.
    7. Information on whether or not the right of withdrawal is applicable and any desired procedure shall be clearly stated on the website in good time before the conclusion of the contract.
    8 . The right of withdrawal does not apply to:
    -Products that have been created by the entrepreneur in accordance with the customer's specifications;
    -Loose newspapers and magazines;
    -Audio and video recordings and computer software of which the customer has broken the seal;
    -Products that for reasons of health protection or hygiene are not suitable to be returned and of which the seal has been broken after delivery;
    -The delivery of digital content other than on a tangible medium if the performance has begun with the customer's express prior consent and he has declared that he thereby loses his right of withdrawal.

Payment
1. Customer shall make payments to MEC Shop B.V. according to the payment methods indicated in the order procedure and possibly on the website. MEC Shop B.V. is free in its choice of payment methods and these may also change from time to time. In case of payment after delivery, the customer has a payment period of 14 days starting on the day after delivery.

Warranty and conformity
1. MEC Shop B.V. warrants that the products comply with the agreement, the specifications mentioned in the offer, the reasonable requirements of soundness and/or usability and the existing legal provisions and/or government regulations on the date of the conclusion of the agreement. If specifically agreed, MEC Shop B.V. also guarantees that the product is suitable for other than normal use.
2. A guarantee provided by MEC Shop B.V., manufacturer or importer does not affect the legal rights and claims that the customer already has and can invoke under the agreement.
3. If the delivered product does not comply with the agreement, the customer must notify MEC Shop B.V. of the defect within a reasonable period after he has discovered it.
4. If MEC Shop B.V. considers the complaint justified, the relevant products will be repaired, replaced or reimbursed after consultation with customer. The maximum compensation is equal to the price paid by customer over the product. This article does not preclude a claim for any compensation.

Complaint Procedure
1. If customer has a complaint about a product (in accordance with article on warranty and conformity) and/or about other aspects of the service of MEC Shop B.V., he can submit a complaint to MEC Shop B.V. by phone, e-mail, whatsapp or by mail. See the contact details at the bottom of the General Terms and Conditions.
2. MEC Shop B.V. will give customer a reaction to his complaint as soon as possible, but in any case within 7 days after receipt of the complaint. If it is not yet possible to provide a substantive or definitive response, MEC Shop B.V. will confirm receipt of the complaint within 7 days of its receipt and provide an indication of the period within which it expects to provide a substantive or definitive response to the customer's complaint.
3. Customer may also submit a complaint via the European Dispute Resolution Platform, accessible at https://webgate.ec.europa.eu/odr/.

Personal data
1. MEC Shop B.V. processes customer's personal data in accordance with the privacy statement published on the website.

Final Provisions
1. The agreement is governed by Dutch law.
2. Insofar as rules of mandatory law do not prescribe otherwise, all disputes that may arise in connection with the agreement will be submitted to the competent Dutch court in the district where MEC Shop B.V. has its registered office.
3. If any provision of these General Terms and Conditions proves to be invalid, this shall not affect the validity of the General Terms and Conditions as a whole. The parties will in that case adopt (a) new provision(s) to replace it, which as far as is legally possible will give shape to the intention of the original provision.
4. In these General Terms and Conditions "in writing" also means communication by email and whatsapp, provided that the identity of the sender and the integrity of the email has been sufficiently established.
